Use Of The Site and my Services
References to “I”, “me” or “my” throughout this Website (‘the Site’) pertains to Ranadeep Ghose who operates the Site.
I reserve the right to modify these terms and conditions from time to time without any prior notice, after which the use of my website will be governed by that revised version. You are hence, recommended to check the terms and conditions on the website regularly. Keep in mind that use of Ranadeep Ghose’s services is also subject to, and controlled by, the Agreement subscribed to by the User, and the use of the website is also subject to the Privacy Policy notified on the website.
General Terms
Ranadeep Ghose is an online business consultant and web solutions provider based in Kolkata, West Bengal, India and the project execution (design/development/SEO/SEM activities) of all the projects I undertake will be taken place at my development centers in India. My normal working hours are from 10 AM to 6:30 PM, IST, from Monday to Friday and from 10 AM to 2:30 PM on Saturdays. All Sundays will be considered non-working days. All public holidays in India or in the state of West Bengal will also be considered as non-working days.
Use Of The Site
There is no charge imposed by me for accessing the Site but you are liable to pay the cost of the communications link you used to visit the Site.
Access to the Site may be suspended, restricted or terminated any time. I cannot guarantee that the Site will be error-free and I am not to be held liable for unavailability of the same.
The content of the pages on the website are for general information and use only. It is subject to change without notice.
Neither Ranadeep Ghose nor any third party provide any warranty or guarantee to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the website for any particular purpose.
Ranadeep Ghose shall not be in any way liable for any inaccuracy, error, defect or fault related to the information and materials found or offered on the website.
Use of any information or materials on the website is entirely at User’s own risk, for which Ranadeep Ghose shall not be liable.
It shall be User’s own responsibility to ensure that any product, service or information available through the website meets the User’s requirements.
Unauthorized use of the website may give rise to claim for damages and/or it will be a criminal offense punishable under the applicable penal law.
Pricing, Subscriptions, Cancellations, Refunds
1. Pricing
There are two types of pricing structures. One-time pricing and subscriptions.
2. One-Time Prices & Subscriptions
One-time pricing is generally applicable for customized and bespoke services which are created once and delivered upon completion to clients. Once completed and delivered, the contract is deemed to be successfully executed and the one-time payment received against the same will be considered as closure of the order unless specifically and explicitly mentioned. Any further works on that particular customization will incur additional cost.
Subscriptions are monthly charges with annual commitments or monthly charges billed annually as per agreement with the client. The subscription charges are typically applicable for the managed packages as mentioned in the Managed Solutions section of this website. The subscription for a particular package will be payable monthly for a minimum of 12 months or the total amount for the year as calculated can also be paid in advance together. The minimum term for subscriptions is 12 months. All features listed in the subscribed particular managed package will be available for 12 months. Any additional feature, or any feature as mentioned in the feature list which requires additional charges will not be included in the subscription. Features of a subscribed package can change from time to time based on various factors like policy change in third-party platforms, technical issues and incompatibility arising out of upgradations of technology etc. Under such circumstances, if any feature is removed from the subscription package, I will try to provide the same for at least until the subscription period is over if conditions permit, otherwise the feature can be removed instantly. However, if a new feature is added to the list of a subscribed package, the feature will be instantly provided without any additional cost for that particular subscription period. Any changes to a subscribed package will only reflect at the time of renewal and no pricing changes will be effective mid-way through a subscription tenure.
In case of one-time pricing for customized and bespoke services, 50% of the total billed amount is required to be paid in advance before the work commences and the remaining 50% is required to be paid either on completion of milestones or before the final delivery of the service as per agreement with the client. In case of monthly subscription with annual commitment, you are required to allow automatic monthly deduction of the subscribed package amount through credit card or eMandate wherein the said amount will be deducted from your bank account on a specific date every month until the subscription term is over. If such a payment fails, the account will be instantly put on hold, the services will be stopped and a penalty may be levied until payment is resumed and the subscription term is completed. In case of monthly subscription billed annually, payment for 12 months is required to be paid in full before the service commences.
3. Cancellations & Refunds
All cancellation requests need to be provided in writing through email to hello@ranadeep.com
In case of customized and bespoke services, cancellation is allowed within 24 hours of making the initial 50% payment. Once cancellation request is received the entire amount will be refunded through cheque payment within the next 72 hours. After 24 hours of receiving the initial payment the work for customized and bespoke services will commence and hence any cancellation after the initial 24 hours will result in forfeit of the 50% advance. However, files and deliverables of any work done until the cancellation request is received will be handed over to you within the next 72 hours.
In case of subscriptions, since the services are based on yearly commitment, cancellation would only mean termination of services with immediate effect but refunds are not applicable. 100% of the subscription amount will be forfeited in case of such cancellation.
4. Upgrading & Downgrading
In case of subscription to base packages or security & maintenance services, you can upgrade / downgrade from one package to another.
In case of upgrade, your new package features will be available from the next billing date on completion of successful payment. The new subscription price will also be applicable once the present billing cycle is completed.
In case of downgrade, the new prices will be applicable from the next billing cycle. Several features as per your packages selected would be withdrawn once the new billing cycle and payment plan is put into effect. This could result in potential loss of data as the services now stopped will be completely removed from your system. It will be your prerogative to backup and copy such data and I shall not be held responsible for any such loss.
